License Agreement

This License Agreement (“Agreement”) is a legal document governing the use of the products created by Beatrice Barberis (legal name: Maria Beatrice Barberis, Italian tax code: CF: BRBMBT89L53F205L, the “Author”), unless otherwise specified. By accessing, downloading, or using the products, you agree to be bound by the terms of this Agreement. If you do not agree to these terms, you may not use my products.

1. Ownership and Rights Reserved

Unless expressly stated otherwise, all rights to the products are reserved exclusively by the Author. This includes, but is not limited to, rights to reproduction, distribution, display, and modification of the products. The Author retains full copyright ownership.

2. Permitted Use

The products provided by the Author may only be used for personal purposes. This means that you are authorized to view, use, and store the products on your personal devices for private, non-commercial purposes.

3. Free Products – Limited Sharing Rights

For products designated as “free” or otherwise freely available:

  • You may share these free products without charge, but only if you clearly attribute the Author as the creator.
  • No commercial or for-profit distribution is permitted without obtaining explicit, prior written permission from the Author.

4. Prohibited Uses

Unless the Author has explicitly provided written consent:

  • You may not use the products for any commercial purposes, including but not limited to selling, licensing, renting, or otherwise monetizing the products.
  • You may not modify, translate, adapt, or create derivative works from the products for distribution or commercial purposes.
  • You may not remove, obscure, or alter any copyright, trademark, or other proprietary rights notices on the products.

5. Commercial Licenses

If you wish to use any of the products for commercial purposes, please contact the Author directly. Commercial licensing options may be available upon request.

6. Disclaimer and Limitation of Liability

The products are provided “as is” without warranties of any kind, either expressed or implied, including but not limited to the implied warranties of merchantability and fitness for a particular purpose. In no event shall the Author be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the products, even if the Author has been advised of the possibility of such damages.

7. Termination

Any use of the products outside the scope permitted by this Agreement will automatically terminate your rights under this license and may result in legal action. Upon termination, you must immediately cease all use of the products and delete all copies in your possession.

8. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of Italy. Any disputes arising from or related to this Agreement shall be resolved in the courts of Italy.

Image License for Photography and Video

These terms and conditions (the “Policy”) govern the use of stock and editorial images (the “Images”) licensed by Beatrice Barberis (legal name: Maria Beatrice Barberis, Italian tax code: CF: BRBMBT89L53F205L, the “Licensor”), with an address at Via Ettore Ciccotti 10 in Rome, Italy. The Licensor is the sole and exclusive owner of all rights in and to the Images.

Grant of License

Upon payment of the applicable license fee, the Licensor grants to the Licensee (the “User”) a non-exclusive, non-transferable, worldwide license to use the Images following the terms of this Policy.

Use of Images

The User may use the Images for the following purposes only:

  • Editorial Use: The Images may be used to illustrate news, commentary, or other factual content.
  • Commercial Use: The Images may be used for commercial purposes, including advertising, marketing, and promotion. However, the Images may not be used in any way that suggests or implies that the Licensor or the Photographer endorses any product, service, or brand.

Restrictions on Use

The User may not use the Images for any of the following purposes:

  • Pornographic or Defamatory Use: The Images may not be used in any pornographic, defamatory, or otherwise offensive manner.
  • Illegal Use: The Images may not be used for any illegal or unlawful purpose.
  • Misrepresentation: The Images may not be used in any way that misrepresents the Licensor, the Photographer, or the Images themselves.
  • Removal of Watermarks: The User may not remove or alter any watermarks or copyright notices that are embedded in the Images.

Credit and Attribution

The User must credit the Licensor and the Photographer in all uses of the Images. The credit must be displayed in a prominent and easily readable location, and must include the following information:

Indemnification

The User agrees to indemnify, defend, and hold harmless the Licensor, its affiliates, and its licensors from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or in connection with the User’s use of the Images.

Termination

The Licensor may terminate this Policy at any time for any reason, with or without notice. Upon termination of this Policy, the User’s right to use the Images shall immediately cease.

General Provisions

This Policy is governed by and construed following the laws of Italy. Any dispute arising out of or in connection with this Policy shall be resolved by arbitration following the Italian Arbitration Law. This Policy constitutes the entire agreement between the parties concerning the subject matter hereof and supersedes all prior or contemporaneous communications, representations, or agreements, whether oral or written. If any provision of this Policy is held to be invalid or unenforceable, such provision shall be struck from this Policy and the remaining provisions shall remain in full force and effect.

3D Models License Agreement

By downloading or using my 3D models, you agree to the terms outlined in this agreement.

1. Permitted Uses:

  • The 3D models are licensed for personal use and for creating derivative works such as animations, video games, visualizations, or other creative projects.
  • You may use the models for non-commercial and commercial projects, provided that the models themselves are not redistributed, shared, or sold in any form, modified or unmodified.

2. Prohibited Uses:

  • Redistribution, resale, sublicensing, or sharing of the 3D models or their files, whether in original or modified form, is strictly prohibited.
  • Incorporating the models in stock media, templates, or assets intended for distribution is not allowed.
  • Use of the models for any unlawful, defamatory, or fraudulent purposes is prohibited.

3. Intellectual Property and Attribution:

  • You acknowledge that any original images or textures used in the models are the property of their respective copyright holders. You may not claim ownership over such materials.
  • If derivative works based on the models are publicly displayed, attribution to the original creator (Maria Beatrice Barberis, a.k.a. Beatrice Barberis) is appreciated but not required.

4. Warranty Disclaimer:

  • The 3D models is provided “as is” without any express or implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
  • The creator does not guarantee that the models will function as intended in all systems or software environments.

5. Limitation of Liability:

  • Under no circumstances shall the creator be held liable for any direct, indirect, incidental, or consequential damages arising from the use, misuse, or inability to use the 3D models, even if advised of the possibility of such damages.

6. Governing Law and Jurisdiction:

  • This license shall be governed by and construed in accordance with the laws of Italy.
  • Any disputes arising from this license agreement or the use of the 3D models shall be exclusively submitted to the jurisdiction of the courts of Italy.

7. Termination:

  • This license is effective until terminated. Breach of any term of this agreement will result in immediate termination of this license. Upon termination, you must destroy all copies of the 3D models in your possession.

8. Updates to the License:

  • The creator reserves the right to update this license agreement at any time. Continued use of the models after any updates constitutes acceptance of the revised terms.
